The Agreement of Purchase and Sale is the document that is commonly used in Ontario,Canada to make an offer to buy a house. It shows the buyer's intent to purchase a property and to negotiate the terms of the Sale. It is commonly referred to as an "Offer". This document allows the Buyer to outline the conditions they wish to be placed in their offer to buy the seller's property. Some common examples of a Buyer's conditions include arranging financing for the property to be purchased or completing a home inspection. The Seller, in turn, may want to make changes to the offer for the Buyer to consider. This process can continue back and forth several times in an effort to reach an agreement. The Agreement of Purchase & Sale includes the Purchase Price, Deposit, Irrevocability, Completion Date, Chattels Included, Fixtures Excluded, Rental Items, HST, Title Search, Future Use, Title, Schedule A, Closing Agreements etc.. It's Mark Woehrle, Remax Escarpment.We're going to talk about writing an offer today and the agreement of purchase and sale. On it we start out with the date, of course, we put in the buyer name and the seller name. We put down the address that you are looking to buy. We talk about the frontage and the depth and of course your purchase price. After that, you are going to submit a deposit and we're going to give a time to the seller to respond to us. One of the key components to your agreement of purchase and sale is the irrevocable date. It is the day and the time that the other party as to respond to your offer. Until then your offer is open and they can either accept your offer, reject your offer, or make you a counter offer. Or, if they really don't like your offer and they get something else that is even better, they don't have to respond to you. The next thing that we will discuss is the completion date. That is the day that you would like to move into your new house. This again, is negotiable. The next thing we talk about is chattels, which are things like your fridge, stove, microwave, dishwasher, washer, dryer, any sheds, riding lawn mower, stuff like that. Sometimes they tell you in the listing if those are already included or if you have to ask for them. Then we talk about fixtures excluded. Sometimes sellers say, I want to keep this beautiful chandelier here. It's been in my family for three generations. Then we talk about rental items. For example, a hot water heater is very common item to have rented. Some people also have furnaces or air conditioners, heating pumps, also on rental. You want to know about that. The next thing we talk about is the HST. In a resale home the HST is generally included unless you did a lot of renovations. The next thing we need to talk about is the title search date. This is the date that your lawyer will have until to search the zoning. The use on your house most likely single family residential is what it can be legally used for. If you are buying a duplex, triplex, or a commercial building, you want to make sure that you can use your building for what you want to use it for. Don't just go by what the seller represents. Make your own inquiries always. At the end of the agreement, you have to sign your name and date it. And I have to witness that for you and sign it myself. The next part of the agreement we are going to talk about is generally called Schedule A and those are some of the conditions. The first condition is always to pay the balance of the purchase price subject to adjustments to your lawyer. Some more popular conditions are number one: Home inspection obviously. Number two: Financing. Number three: That you are getting insurance. Number four: That you are requesting a survey. And maybe you want to ask for the utility bills for the last year. Maybe you would like to view the property one or two or three more times. And if there is anything else that you would like to have as a condition, you can ask for it in this section here. As an investor, you need to do prudent research and be 100% sure that the person you're buying from has a clear title to the property. You need to ensure that you're getting a deed and paying the actual property owner (not somebody else who thinks they own the property, or is lying to you and claiming that they own it). When I bought my first house, this whole concept really confused me and if you're new to real estate, it may seem confusing to you too... Why A Clear Title Matters In a lot of ways, it's a similar process to buying an car. Suppose you see a car parked in someone's driveway with a "FOR SALE" sign in the window. The car looks nice, so you walk up to the house, knock on the door and say "I saw this car parked in your driveway, is it yours?" The person replies, "No, but I'll sell it to you for $10,000!" There's obviously something wrong with this picture. A person can't sell something they don't legally own -- and while it sounds like a ridiculous conversation, you'd be surprised at how often I've come across situations just like this in the real estate business. How does this kind of issue come up in the first place? There are a lot of ways but most often, I come across people who have inherited property from their parents or relatives and somewhere along the way, the proper paperwork was never filed to give them the legal right to sell the property. Other times, people buy properties without doing their own due diligence and then THEY get stuck with a property without a clear title. One way or another, people can end up with their name on the tax bill (and in some cases, on the actual deed), but somewhere in the "chain of title" (as recorded in the county's historical documentation of the property) the property wasn't transferred correctly from seller to the buyer. Another key reason you'll want to do a title search is to make sure there aren't any liens or mortgages on the property. Especially when you're offering people a very small amount of cash for their property (like I tend to do), there will be times when they conveniently neglect to mention that they have a $100,000 mortgage or $20,000 construction lien that is still tied to that property. If you fail to catch this in your title search before closing on the deal, these issues will fall into your lap along with the property. If you make enough offers and buy enough properties, you will eventually run into this issue. When you do, it's usually a problem that doesn't have a quick or easy solution. Knowing When It's Worth The Price Admittedly, doing your own title search will open you up to some risk. There is always the possibility that you'll miss some crucial piece of information along the way. However, I have done a few dozen title searches on my own over the years and I have never been burned by it. As a personal rule -- the only time I do my own title searches is when the expected market value of the property is less than $10K (i.e. -- we're talking exclusively "rinky dink" properties here). As soon as I start dealing with substantial deals in the tens of thousands, I never leave it to chance. In this edition of Grant Cardone’s Real Estate Show the topic is on multi-family value-add. When you are buying apartments, how can you add value to get more income? Tips to find the value-add in the deal include the following: 1.Rent Disparity— look for markets where there is a big difference in prices, where there are $800 rents in the ghetto and then jump to $3000 in other areas. Where’s the middle? Look for markets where there is big rent disparity. 2.Timing—there are certain times better than other times, and to know the timing you have to be in the marketplace. 3.Kitchens and floors— You don’t get a pool to raise the rent, but to make it easier to rent. Amenities make it easier to close the deal with people. Washers and dryers will cost money to install but will make it easier to rent for many people. Would you spend $600 to get back $65 a month? Invest something to get something back. Think about things people will pay for like parking or VIP trash pick-up. This is an incoming producing business so get creative. Don’t do baby steps in real estate. If you do, you’ll be punished. Save your money until you can go big. You need to be buying things that will produce income right away. Should you buy or rent a house is one of the rising concerns of date. Till the late 1980s, it was the standard middle class dream to be able to somehow garner enough money to buy one's home. You saved for many years, sold some family jewels and borrowed from friends and family. Overtime, you somehow paid back friends and family. The script changed in the 1980s with the arrival of home loan companies. Now, instead of borrowing from friends and family, you could take a home loan. The only difference is you have to begin repayment immediately and pay back on a regular basis till eternity (or so it feels). Given the easy availability of home loans, the number of people who can buy their own home has multiplied exponentially and so does the property prices. This has resulted in the rent-versus-buy debate arriving on Indian shores as well. Does it make sense to buy your own home or to stay on rent? Due Diligence - Real Estate Investing with Grant Cardone. When you buy a property, what should you do first? You do your due diligence. What is due diligence? Reasonable steps taken by a person in order to satisfy a legal requirement, especially in buying or selling something. Due diligence gives you, the bank, and investors the confidence about whether you want to do the deal. That is the most important part of due diligence, the simple question of asking yourself “do I want to be in the deal?” 1.Do you want to be in the game? Whether office, single family home, or multi-family…what game do you want to be in? 2.Do you want to be in that deal? Getting more specific, do you want those tenants, that location, that building? Remember that you need a bank on your side. They are your partner. Grant takes 20 days usually with due diligence. What does he look at from the seller? Inspections, rent rolls, T12, rehab information, and income statements. There are 3 kinds of income statements. Real ones, fake ones, and mom and pop ones. The mom and pop statements end in all 0’s. Sandra Rinomato: Answers to your real estate questions Every region has their own real estate season and in my area of Toronto, the month that has the highest activity level and highest prices has almost consistently been the month of April. So does that make it the best time to buy? Maybe--maybe not. In April you have a lot of competition, many other properties are for sale. Depending on the number of buyers for your product, you may suffer due to the high supply levels. Some buyers wait to purchase in April thinking they will have more to choose from. Will your home be "the one" or will it be put on a list with many other properties? Some sellers take advantage of low inventory levels and sell over Christmas and New Year's Eve, for example. Many people prefer to take their homes off the market at that time of year and we see plummeting inventory levels, but many buyers have the time to shop for a home over the holidays and will snatch up just about anything that is available. People sell for many reasons, regardless of the season or real estate market trends. If you have to buy and sell at the same time, trying to time it all can drive you bonkers! The best answer I can give for this question is, the best time to buy is when you are ready! Is your family growing, or kids moving out, or work situation changing? Then it may just be the perfect time to make your real estate move. Is a home inspection always necessary? Having a home inspector walk you through your home and point out important features like the water shut off valve, point out how the downspouts are too close and may cause a leaky basement and 2 hours worth of similar information is invaluable for many people. A practiced eye can detect moisture damage and electrical issues, can identify toxic insulation in your attic. It is almost always preferred to have an inspection, but in some cases you may find yourself in a situation where you just don't have time to get one and you have to make a decision on a house. In the areas where this is likely wise home sellers may choose to have a pre-sale home inspection completed and make the report available to potential buyers. Without it, sellers run the risk of losing a buyer or three. With a pre-sale home inspection buyers feel a bit more confident in what they are bidding on, and know how much to bid. Most buyers are working with a licensed realtor and will learn of the new listing with plenty of time to perform their own due diligence before the offer date. It is quite common for buyers to have a home inspection performed before they offer. They don't own it yet, and may fail to win in competition, but they feel the $500 was well worth the investment. Some buyers pay for more than one home inspection by the time they are successful in bidding wars.
