How to File Consumer Complaint Online in india | By Ishan [Hindi] Who is a Consumer?: Any individual who purchases products or services for his personal use and not for manufacturing or resale is called a consumer. A consumer is one who is the decision maker whether or not to buy an item at the store, or someone who is influenced by advertisement and marketing. Every time someone goes to a store and buys a shirt, toy, beverage or anything else, they make a decision as a consumer. Consumer refers to any person who purchases some goods for a consideration that has been either 1.paid or promised to pay or 2.partly paid and partly promised, or 3.found under any system of deferred payment and does include any user of this type of goods other than the person who purchases these types of goods for consideration paid or promised or partly paid or partly promised, or 4.under any type of system of deferred payment when this type of use is done with the agreement of such person, and does not include a person who gets such goods for resale or for any business purpose or hires or avails of some services for a consideration which has been paid or promised or partly paid and partly promised, or 5.under some system of deferred payment as well as includes some beneficiary of such services other than the people who ‘hire or avail of the services for consideration paid or promised, or partly paid and partly promised, or 6.under any system of deferred payment, when such services are provided having the approval of the first described person and does not include a person who takes such services for any business purposes. Consumer Court is the special purpose court, in India, that deals with cases regarding consumer disputes and grievances. These are judiciary hearings set up by the government to protect the consumer rights. To lodge a complaint, the consumer has to first register on the site. The online registration form has to be filled in with the name, email, address and phone number of the complainant, and an user id and password have to be created. Samsung has opened its new mobile factory in India. This factory is said to be the world's largest mobile factory. The factory plot which is of 35-acre, is situated at Sector 81 in Noida, Uttar Pradesh. Prime Minister Narendra Modi and South Korean President Moon Jae will be officially inaugurating the Samsung Electronics factory on Monday. By opening the new factory, Samsung India aims to increase its overall production to 50 per cent in the next three years, which is currently at 10 per cent. 1. Samsung is currently making 67 million smartphones in India and with the new plant, the company is aiming to manufacture nearly 120 million mobile phones. Commenting on the new Samsung plant, Tarun Pathak, Associate Director at Counterpoint Research says that the new factory will reduce the time to market for Samsung. "This will help Samsung bring some local features to the devices powered by R&D here. Apart from this, the company can also bring in export opportunity for Samsung to SAARC and other regions," Pathak told IANS. 2. Back in June 2017, the South Korean giant had announced a Rs 4,915 crore investment to expand the new Noida plant. It just a year after a new of the announcement, Samsung's Noida plant is all-ready to double production. By setting up the new plant Samsung is not only aiming to double its mobile phone production but other consumer electronics products as well, like refrigerators and flat panel televisions. 3. According to HC Hong, President and CEO, Samsung India, a bigger manufacturing plant will help the company cater to the growing demand for Samsung products across India. 4. Established in 1995, Samsung India laid the foundation for the Noida plant next year, 1996. In 1997, the production commenced and the first Samsung TV was rolled out to the market. It is in 2003 that the Samsung initiated the refrigerator production in the country. It is in just a couple of years, that is by 2005, Samsung had become the market leader in manufacturing TV panels. In 2007, the existing Noida plat started manufacturing mobile phones. In 2012, Samsung became the leader in mobile phones in the country and the Noida facility rolled out the first-ever Galaxy S3 device. Today, Samsung is among the top mobile brands in India. With the new Noida plant Samsung is expecting to expand its mobile business in the country. To recollect, Samsung India has registered around 27 per cent growth in mobile business revenue for the financial year 2016-17. 5. Samsung currently has two manufacturing plants in the country -- one in Noida and the second one in Sriperumbudur, Tamil Nadu. There are five R&D centres, and one design centre in Noida, where somewhere over 70,000 people work. According to Haque, the Wall Street is very appreciative of Indian consumer Internet companies, owing to its strong demographic favourables -- in terms of a growing domestic consumption story and a rapidly increasing disposable middle-class income. He also adds that the valuations, particularly for the consumer Internet companies, are extremely overbidden or overhyped and they will soon see a correction. He is particularly bullish on three sectors in India -- IP-driven companies which can automate IT services, medical devices and consumer Internet, although it's a little overheated. In a quick chat at the recently concluded VCCircle Bengaluru investment forum, Haque, with a childlike smile, added that valuations would follow a cyclical pattern and that the valuations, which had been overbidden, would soon see a correction. Promod Haque has more than 20 years of experience in the venture capital industry and currently serves as managing partner at Norwest Venture Partners (NVP). Promod joined NVP in 1990, and has invested in more than 60 companies since he began his venture career, producing nearly $30B in exit values to date. More than 20 of his portfolio companies have gone public and nearly 35 have been acquired (or have gone public and been acquired). Promod was ranked as a top investor on the annual Forbes Midas List for nine years, and in 2004, Forbes named him as the #1 venture capitalist based on performance over the previous decade. In 2006, Promod was presented with a Global Leadership award from NASSCOM, and he was recently honored with the 2011 SV Forum Visionary Award based on his outstanding achievements and contributions to the technology industry. How to File a Complaint in Consumer Court in Hindi | By Ishan If the developer refuses or neglects the notice, the you can approach the consumer court. Submit a formal complaint under the Consumer Protection Act, 1986. You need not hire a lawyer for filing the suit. Fill this complaint form and submit it to the commission. Consumer Protection Act, 1986 is an Act of the Parliament of India enacted in 1986 to protect the interests of consumers in India. It makes provision for the establishment of consumer councils and other authorities for the settlement of consumers' disputes and for matters connected therewith also. We are all consumers of goods and services in one way or the other. The moment we take birth on this earth we become consumers and are entitled to seek relief under the Consumer Protection Act. These days we see that consumers are cheated and harassed in many ways. At times they are provided with inferior quality of goods, at times with less quantity than actually demanded whereas at other times the consumer is charged with excess prices than otherwise fixed for the commodity. The traders considers consumers as persons who are morons having paying capacity and can try to deceive them in every possible way. Therefore there was a strong need felt to protect the consumers. HOW TO FILE A CONSUMER COMPLIANT?: Before formally filing a Consumer Complaint, it is desired that the Consumer gives notice to the opposite party of the fact of any deficiency in service or of unfair trade practice etc to see if the trader is willing to make good the loss suffered by either replacing the commodity or returning the value of the purchase. If yes, the issue resolves then and there. But if the trader refuses or neglects here that the consumers needs to approach the Consumer Court. STEP 1:At first identify the Jurisdiction of the Forum where the complaint is to be filed. This issue needs to be identified from two angles of jurisdiction i.e. Territorial and Pecuniary. Step 2: You will be required to pay a prescribed fee along with your complaint before the District Forum, State Commission & the National Commission as the case may be. Step 3:Then you have to draft your complaint stating facts necessary to establish a cause of action. Step 4:At the end of the complaint you have to put your signatures. In case any other person is authorised to file the complaint then complaint has to be accompanied with authorisation letter. Step 5: Don’t forget to mention the name, description and address of the complainant and the name, description, address of the opposite party or parties against whom relief is claimed. Step 6: Copies of all the documents supporting your allegations. In this you can put on record the copy of the bill of the goods bought, warranty and guarantee documents and also a copy of the written complaint and notice made to the trader requesting him to rectify the product. Step 7: You can also ask for compensation costs which should be specifically alleged in the complaint. Besides compensation, a consumer can also ask for the refunds, damages, litigation costs, and interest amount. You must give the breakup of amount claimed under different heads but do remember to claim compensation or other relief as per the pecuniary value of the forums. Step 8: Explain in your complaint as to how the case falls within the jurisdiction of this forum. Step 9: Complaint must clearly state as to what relief is sought against the opposite party. Step 10: The Act provides for limitation period of two years from the date of cause of action. In case there is delay in filing the complaint, please explain the delay which can be can be condoned by the Tribunal. Step 11: You are also required to file an affidavit along with the complaint that facts stated in the complaint are true and correct. Step 12: The complainant can present the complaint in person or by his/her authorized representative without engaging any advocate. The complaint can be sent by registered post. A minimum of 5 copies of the complaint is to be filed in the forum. Besides this you have to file additional copies for each opposite party.
