EXP: “How to file a complaint”. A simple guide to help you file a complaint in case you have a legitimate problem when buying an item or service. And with you today… PST: Professor KnowItAll… EXP :Ok, Professor KnowItAll, go ahead… PST: Thank you, thank you… Well, let me tell you. If you have a problem with a purchase, the first thing you should do is complain to all your friends on social media… EXP: No, not at all! I have the Consumer Action Handbook here, and it says the first thing you should do is inform the seller about the problem. Most complaints are actually resolved that way. My name is Rebecca. Complaining is something that most people don't enjoy doing. But sometimes, it's necessary for us to get what we need or want or deserve. In this lesson, I'll show you an easy three-step process to complain effectively in English. Let's get started. Okay. So the three steps are: First, state the problem; second, express your feelings; and last, ask for action. Let's look at some examples of how this works. Let's say you have no hot water in your hotel room. So state the problem. You say, "We have no hot water in our hotel room. This is unacceptable. Please transfer me to another room." Okay? So, "I have no hot water. This is unacceptable. Please transfer me to another room." Right? State the problem; express your feelings; ask for action. It's very important to do this last part. Some people just do this part. They state the problem, or they grumble by stating -- they're expressing their feelings. But they don't tell people what they want them to do. So if you really want action, make sure you ask for what you ask for what you want someone to do to fix your problem, okay? Next, you're in a restaurant, and the food isn't to your satisfaction. So you say, "The food is cold. This is ridiculous. Please bring us some hot food." Okay? One, two, three. Next, "The Internet is down" -- "the Internet is down" means the Internet is not working, all right? "This is unacceptable. Please credit me for the lost hours." Okay? Another example, "You overcharged me for this item. This is wrong. Please give me a refund." Okay? So you see, by following this three-step process, it's a very easy way for you to complain about anything that you're having a problem with, okay? So remember, don't forget to ask for action, because without that, people may come up with a solution which you don't really like. And you want to make sure that people do what you want them to do, for example, give you a refund, or for example, not just fix your Internet, but give you a credit for the hours that you lost. So by you stating what you want, there's a much greater likelihood that the problem will be fixed in a way that makes you satisfied, okay? For example, let me tell you what happened to me the other day, a really bad experience. I went to the supermarket. I was really hungry. I had nothing at home to eat. And I bought a roast chicken. And that was going to be my dinner. So I took it home, spent a good amount of money for that chicken, prepared some other things to eat with the chicken. And finally, when I was about to sit down, I opened up the chicken, and what do I see? Somebody had actually eaten a part of the leg. One of the legs was eaten, and the bone was left there. I mean, can you imagine my shock? I was absolutely disgusted. I took action. I complained. So what did I do? I told them, "Someone has eaten my chicken! Somebody has eaten one of the legs and actually left the dirty bone there in the package! And you sold me this ridiculous chicken! So this is ridiculous. This is completely wrong. Please give me a refund immediately. Give me a replacement chicken. And in addition, I'm going to write to your management because this is a health hazard." So depending on what the situation is, you can decide how much you complain, what you ask for. I did, by the way, get a replacement chicken. I did get my money back in addition. And I'm planning to follow up with the management because it's really crazy, isn't it? So I hope you've learned from this, how to complain. In fact, research has found that this trick can triple your chances of a successful outcome. Step 2: Include back-up State the problem and include any back-up materials, such as a sales receipt or any previous correspondence. This will show that you are a serious person who will not be ignored until your complaint is resolved. Tip In addition to your address and phone number, include your email address for a speedy response. Step 3: Be specific State exactly what the company can do to keep you as a customer, whether it’s a refund, store credit, or a replacement. Step 7: Spell check Don’t forget to spell check your letter. Misspellings make the reader perceive you as unintelligent, which may make them not take your complaint as seriously. A few days later she received a call and was immediately given a refund. "Don't be afraid to complain, companies want to hear from you." said Marketing Professor Cait Lamberton. Well, you can know it in a few ways and I'm going to explain them, but one of the ways that you can know it is to look at the second point that you need to understand, is to identify the purpose of the letter because some purposes are more formal than other purposes. All right? For example, some formal letters might ask you to request information; or apply for a job; or complain about a product or a service, maybe to an airline, maybe to a store, something like that; or to make a suggestion or a recommendation. All right? To a shopping mall, to a restaurant, something like that. These are more formal situations. These are when we are writing to people or companies that we don't know. All right? That's the clue: You don't have anybody's name, you just have the name of the company. All right. Semi-formal letters might include things like this: Complaining to a landlord; or explaining something, a problem or a situation to a neighbour; or asking a professor for permission to miss an exam or to submit your assignment late. Whatever it is. Okay? The details vary. Doesn't matter. And here, what's...? What identifies the semi-formal? The semi-formal we know it's still a kind of a formal situation, but here we usually do know somebody's name. You would know the name of your landlord, or your professor, or your neighbour, for example. Right? So that means something in terms of the way that you write the letter, the language, the tone, the style. All of this is affected by whether it's formal, semi-formal, or informal. And I'll explain more to you as we go along. Now, examples of informal letters might be where you're being asked to invite a friend, or thank a friend, or apologize to a friend, or ask for advice from someone that you know. Okay? Here what's important is that you really know this person well and you're probably going to call them by first name. So I'm going to explain exactly how all of this translates into the next step, which is how you begin your letter. So the first step was to identify the type of letter. Second step, the purpose. Now the third step is to open and close the letter correctly. Once you've done steps one and two, you will know how to do this step. Because if it's a formal letter then you start with: "Dear Sir" or "Madam", and you end with: "Yours faithfully". Okay? That's how it is. HOW TO FILE A CONSUMER COMPLIANTकैसे करे उपभोक्ता फोरम में शिकायत दर्ज़ - जानिये दोस्तों, आज के समय में ग्राहक जमाखोरी, कालाबाजारी, मिलावट, बिना मानक की वस्तुओं की बिक्री, अधिक दाम, गारंटी की सुविधा का लाभ न मिल पाना, हर जगह ठगी, कम नाप-तौल आदि धांधलियों से ग्राहक घिरा हुआ है। इन सभी समस्याओं को देखते हुए ग्राहक संरक्षण के लिए कुछ कानून बनाए गए हैं, जिससे कोई भी दुकानदार ग्राहक के अधिकारों का हनन न कर सकें | Before formally filing a Consumer Complaint, it is desired that the Consumer gives notice to the opposite party of the fact of any deficiency in service or of unfair trade practice etc to see if the trader is willing to make good the loss suffered by either replacing the commodity or returning the value of the purchase. If yes, the issue resolves then and there. But if the trader refuses or neglects here that the consumers needs to approach the Consumer Court. STEP 1: At first identify the Jurisdiction of the Forum where the complaint is to be filed. This issue needs to be identified from two angles of jurisdiction i.e. Territorial and Pecuniary. The Consumer has to take into consideration both the territorial and pecuniary jurisdiction of the tribunal in mind before filing his complaint and has to choose the correct forum. Territorial Jurisdiction of the Consumer Forums :- A complaint shall be instituted in a District Forum or State Commission or National within the local limits of whose jurisdiction,— a) the opposite party resides or caries on business or has a branch office or personally works for gain, or b) If there are more than one opposite aprty, then any one of the opposite parties resides, or carries on business or has a branch office, or personally works for gain, Provided that in such case the permission of either District Forum, State Commission or National Commission as the case may be, or the opposite parties who do not reside in such place or carry on business or have a branch office or personally works for gain as the case may be, must be obtained , or c) the cause of action arose. PECUNIARY JURISDICTION OF CONSUMER FORUMS Sr No. Forums Amount 1 District Forum Upto Rs. 20 Lakhs 2 State Commission Rs. 20 Lakhs to Rs. 1 Crores 3 National Commission Exceeding Rs. 1 Crores Step 2: You will be required to pay a prescribed fee along with your complaint before the District Forum, State Commission & the National Commission as the case may be. Step 3: Then you have to draft your complaint stating facts necessary to establish a cause of action. Step 4: At the end of the complaint you have to put your signatures. In case any other person is authorised to file the complaint then complaint has to be accompanied with authorisation letter. Step 5: Don’t forget to mention the name, description and address of the complainant and the name, description, address of the opposite party or parties against whom relief is claimed. Step 6: Copies of all the documents supporting your allegations. In this you can put on record the copy of the bill of the goods bought, warranty and guarantee documents and also a copy of the written complaint and notice made to the trader requesting him to rectify the product. Step 7: You can also ask for compensation costs which should be specifically alleged in the complaint. Besides compensation, a consumer can also ask for the refunds, damages, litigation costs, and interest amount. You must give the breakup of amount claimed under different heads but do remember to claim compensation or other relief as per the pecuniary value of the forums. Step 8: Explain in your complaint as to how the case falls within the jurisdiction of this forum. Step 9: Complaint must clearly state as to what relief is sought against the opposite party. Step 10: The Act provides for limitation period of two years from the date of cause of action. In case there is delay in filing the complaint, please explain the delay which can be can be condoned by the Tribunal. Step 11: You are also required to file an affidavit along with the complaint that facts stated in the complaint are true and correct. Step 12: The complainant can present the complaint in person or by his/her authorised representative without engaging any advocate. The complaint can be sent by registered post.
